Social Media Pages Disclaimer, Conditions of Use, and Privacy
Acceptance of Terms
The TJPA may maintain social media pages on outlets such as Facebook, Twitter, and YouTube (“Social Media Pages”). Use of the TJPA Social Media Pages indicates your agreement with the conditions and restrictions described herein. You should refrain from using the TJPA Social Media Pages if you disagree with these conditions and restrictions.
The purpose of the TJPA Social Media Pages are to provide information about the Transbay Transit Center Program and related issues, and to engage the public on issues relevant to the Program.
Conduct and User Content
The TJPA expects that people accessing and using the TJPA Social Media Pages and contributing Content (such as comments, posts, photos, videos, and links) will treat each other with respect and follow the conventions of polite discourse.
The TJPA reserves the right to moderate Content on TJPA Social Media Pages. The TJPA may, in its sole discretion, delete, remove, or refuse to post any Content that the TJPA determines:
(1) concerns a political campaign or candidate, ballot measure, initiative, or other legislation;
(2) contains profanity;
(3) contains abusive, threatening, harassing, or offensive content;
(4) contains libelous, slanderous, or defamatory content, or otherwise makes unsupported accusations;
(5) contains nude, obscene, or pornographic images, by community standards;
(6) advocates or promotes the use of illegal goods or services, or unlawful conduct;
(7) contains graphic violence;
(8) constitutes a personal attack;
(9) infringes on any copyright, trademark, or other protected intellectual property;
(10) contains discriminatory content, or demeans or disparages an individual or group;
(11) constitutes spam;
(12) contains content unrelated to the posted topic;
(13) constitutes advertising (promoting or selling services or products, soliciting customers);
(14) contains, implies, or declares an endorsement by the TJPA, except as expressly permitted by the TJPA.
Communications Not Legal Notice
Communications made through the TJPA Social Media Pages do not constitute legal or official notice or comment to the TJPA, or any official or employee of the TJPA, for any purpose.
Limitation on Liability
TJPA Social Media Pages are provided and maintained as a courtesy to the public. The Content is compiled from a variety of sources. The TJPA neither warrants nor makes representations or endorsements as to the accuracy, quality, content, or completeness of the Content.
The TJPA reserves the right to modify the Content on the TJPA Social Media Pages at any time and without prior notice.
Any reference in the TJPA Social Media Pages to specific products or services, or the use of any trade, firm, or corporation name is for the information and convenience of the public, and does not constitute endorsement, recommendation, or favoring by the TJPA, or its employees or agents. Similarly, any contact with, reference to, friending, or following of a political officer, appointee, or candidate does not constitute endorsement, recommendation, or favoring by the TJPA, or its employees or agents.
The TJPA Social Media Pages and all materials contained herein are distributed and transmitted “as is” without warranties of any kind, either express or implied, including without limitation, warranties of title or implied warranties of fitness for a particular purpose. The TJPA is neither responsible nor liable for any viruses or contaminations of a visitor’s hardware, software, peripherals, or properties nor for any delays, inaccuracies, errors, or omissions resulting from use of or with respect to the material contained on its Social Media Pages, including without limitation but not limited to, any material posted on or linked to/from the TJPA Social Media Pages. The TJPA is not responsible for any special, indirect, incidental, or consequential damages that may arise from the use of, or the inability to use, the Social Media Pages and/or the materials contained on the site, whether the materials contained on the site are provided by the TJPA or a third party.
By accessing the TJPA Social Media Pages, you are accepting the terms described in the Privacy Policies provided by the social media website. Facebook’s policy can be found at http://www.facebook.com/policy.php. Twitter’s policy can be found at http://twitter.com/privacy. Youtube’s policy can be found at http://www.youtube.com/t/privacy_at_youtube.
When you access the TJPA Social Media Pages, you may provide three types of information: (1) web site use information, (2) registration information, and (3) user Content.
The TJPA may collect web site use information for purposes such as assessing the information that is of interest to the public, determining technical design specifications, and identifying system performance or problem areas on the TJPA Social Media Pages. For example, when you visit the TJPA Facebook Page, the TJPA may automatically collect and store the following information:
- The Internet Protocol Address and domain name used
- Browser type used to view the website
- Operating system
- The date and time of the visit
- The pages or services accessed during a visit
- The search engine and terms used to access the TJPA Facebook Page
- The website visited prior to accessing the TJPA Facebook Page
Web site use information does not identify personal information about specific individuals.
When you register with a social media site, you may provide it certain personal information, such as your name, email address, telephone number, mailing address, gender, and schools attended. The TJPA does not store this personal information.
If you post Content on TJPA Social Media Pages, that Content contains personal information. The Content is available to the public. To protect your own privacy and the privacy of others, please do not include phone numbers or email addresses in the body of any Content you post on TJPA Social Media Pages. You post Content at your own risk.
Email addresses submitted to the TJPA in order to subscribe to a TJPA electronic mailing list will be used for that purpose. You may choose to unsubscribe or change your subscription options for any mailing list at any time.
Copies of information and Content on TJPA Social Media Pages is not regularly retained in the course of the TJPA’s business. Information and Content posted on and collected through TJPA Social Media Pages may be a public record that may be subject to disclosure, inspection, and copying by the public. The TJPA reserves all rights to disclose public records as required by law.
Unauthorized attempts to deny service, upload information, change information, or to attempt to access a non-public website from this service are strictly prohibited and may be punishable under Title 18 of the U.S. Code to include the Computer Fraud and Abuse Act of 1986 and the National Information Infrastructure Protection Act.
User Content and External Links
The TJPA Social Media Pages may contain user-provided Content and links to external websites for the public’s information and convenience. The TJPA is not responsible for any user-provided Content or information contained on external websites, and the TJPA has not reviewed such user-provided Content and external websites for accuracy or legal sufficiency. User-provided Content and links to external websites do not constitute an endorsement by the TJPA, and any opinions expressed on user-provided Content and external websites are not necessarily those of the TJPA. Any questions regarding external websites should be addressed to the sponsoring entity.

Choice of Law
Construction of the terms herein and resolution of disputes regarding such terms are governed by the laws of the State of California. The laws of the State of California shall apply to all uses of the TJPA Social Media Pages.
